Terms & Conditions

These Terms & Conditions apply to all bookings made with Endurance Escapes Ltd ("we", "us", "our"). By booking an experience with us, you agree to these Terms & Conditions.

1. Bookings & Payment

• A booking is confirmed once full payment (or deposit, where applicable) has been received.
• Prices are listed in NZD unless otherwise stated.
• We reserve the right to update prices at any time; confirmed bookings will not be affected.

2. Minimum Numbers

• Some escapes require a minimum number of participants to go ahead.
• If minimum numbers are not met, we may offer an alternative date, a credit, or a full refund.

3. Cancellations by You

• More than 14 days before: full refund (minus any non-refundable costs if applicable)
• 7–14 days before: 50% refund
• Less than 7 days before: no refund

Bookings may be transferred to another person subject to approval.

4. Cancellations or Changes by Us

• We may modify or cancel an escape due to weather, safety concerns, track closures, guide illness, or other factors beyond our control.
• If we cancel, you will be offered a refund or credit.
• We are not responsible for additional costs incurred by participants.

5. Weather & Route Changes

• Routes and schedules may be adjusted for safety reasons.
• No refunds are provided for route or itinerary changes due to safety considerations.

6. Health, Fitness & Medical Responsibility

• Participants confirm they are physically fit and have disclosed relevant medical conditions.
• Participation is at your own risk. Please review our Health, Safety & Risk Acknowledgement for full details.

7. Assumption of Risk

Activities involve inherent risks including uneven terrain, weather exposure, physical exertion, remote locations, and limited access to medical care. By participating, you acknowledge and accept these risks.

8. Guide Authority

• Guide decisions are final.
• Participants must follow instructions at all times.
• Participants may be excluded for safety reasons without refund.

9. Equipment & Responsibility

• Participants are responsible for required equipment as communicated prior to the escape.
• We are not responsible for loss or damage to personal belongings.

10. Photography & Media

• Photos and videos taken during our experiences may be used for promotional purposes.
• Participants may opt out by notifying us in writing prior to the experience.

11. Liability

To the fullest extent permitted by New Zealand law, Endurance Escapes Ltd is not liable for injury, loss, or damage arising from participation in our activities. Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other rights that cannot be excluded under New Zealand law.

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If the matter remains unresolved, the parties may agree to mediation in accordance with the Arbitration Act 1996 (NZ). Nothing in this clause limits your right to seek resolution through the Disputes Tribunal or the courts of New Zealand.

13. Governing Law

These Terms are governed by the laws of New Zealand. The courts of New Zealand shall have non-exclusive jurisdiction over any disputes arising under these Terms.

14. Changes to These Terms

We may update these Terms from time to time. The most current version will always be available on this page. Continued use of our services following changes constitutes acceptance.
