Health, Safety & Risk Acknowledgement

This Health, Safety & Risk Acknowledgement applies to all participants taking part in activities organised by Endurance Escapes Ltd ("we", "us", "our"). By booking and participating in an Endurance Escapes experience, you acknowledge and accept the information outlined below.
1. Nature of Activities
Endurance Escapes offers guided endurance activities including, but not limited to:
- Trail running
- Hiking
- Bikepacking
- Multi-day endurance adventures
These activities take place in natural and often remote environments and may involve significant physical and mental exertion.
2. Inherent Risks
You acknowledge that participation involves inherent risks, including but not limited to:
- Uneven or slippery terrain
- Weather changes (rain, wind, heat, cold)
- Physical fatigue and overexertion
- Falls or collisions
- Remote locations with limited access to medical facilities
- Equipment failure
- Encounters with wildlife or natural hazards
These risks cannot be completely eliminated. We take every reasonable precaution, but your safety also depends on your own fitness, preparation, and adherence to guide instructions.
3. Personal Responsibility
By participating, you confirm that:
- You are physically and mentally capable of undertaking the activity.
- You have truthfully disclosed any relevant medical conditions, injuries, or medications.
- You will follow instructions given by guides at all times.
- You will manage your own pace, nutrition, hydration, and wellbeing.
4. Medical Conditions & Emergencies
- You are responsible for carrying any required personal medication (e.g. asthma inhalers, EpiPens, allergy medication).
- In the event of an emergency, you authorise Endurance Escapes guides to seek medical assistance on your behalf.
- You understand that emergency response times may be delayed due to location and conditions.
- Any costs incurred for medical evacuation or emergency services are the responsibility of the participant.
5. Guide Authority
- Guides are responsible for managing group safety.
- Guide decisions regarding pace, route changes, turn-around times, or participant exclusion are final.
- A guide may remove a participant from an activity if they believe continued participation poses a safety risk to the individual or group. No refund is provided in such cases.
6. Equipment
- You are responsible for bringing and using appropriate equipment as communicated prior to the activity.
- Failure to bring required equipment may result in exclusion from the activity for safety reasons, without refund.
- Where equipment is provided by Endurance Escapes, you agree to use it responsibly and report any damage or defects immediately.
7. Weather & Environmental Conditions
- Activities may continue in variable weather conditions where it is safe to do so.
- Routes or schedules may be modified to maintain safety.
- No refunds are provided due to weather-related route changes.
8. Insurance
We strongly recommend that all participants hold appropriate personal, medical, and travel insurance that covers endurance sports and outdoor activities. Endurance Escapes does not provide personal insurance coverage for participants. New Zealand residents may be covered by ACC (Accident Compensation Corporation) for accidental injuries, but participants should not rely solely on this.
9. Assumption of Risk
By participating, you knowingly and voluntarily assume all risks associated with these activities, whether foreseen or unforeseen. This acknowledgement does not limit or exclude any rights you may have under the Consumer Guarantees Act 1993, the Health and Safety at Work Act 2015, or any other applicable New Zealand legislation.
10. Acknowledgement
By booking and participating in an Endurance Escapes experience, you acknowledge that:
- You have read and understood this Health, Safety & Risk Acknowledgement.
- You accept the inherent risks involved.
- You agree to comply with all safety instructions and requirements.
